Terms & Conditions

These Terms and Conditions (“Agreement”) govern all services provided by Anthony Johnson Photography, a professional photography business based in Cedar Park, TX (“CREATOR”), to any individual or organization (“CLIENT”). By booking or commissioning services, the CLIENT agrees to these terms in full.

1. Scope of Services

Anthony Johnson Photography offers professional photography services including (but not limited to) Express Headshots, Office & Team Headshots, Signature Portrait Sessions, and Corporate Event Photography. Each session may vary in terms of inclusions, usage rights, and deliverables.

2. Digital Delivery Only

All services are digital in nature. No physical products (e.g., prints, USB drives, albums) are offered or delivered.

3. File Delivery & Access

Final images will be delivered either:

• As a web-optimized zip file via email, or
• Via a private, online gallery for upgraded experiences (where available).

The online gallery remains active for two (2) weeks from the delivery date unless otherwise agreed. The CLIENT is responsible for downloading, storing, and backing up their files during this time.

4. File Backup & Recovery

The CREATOR retains backups of final delivered images for up to 12 months from the original session date.

• Within 30 days: Re-delivery is complimentary.
• After 30 days: A $295 administrative fee applies for file recovery unless the CLIENT has purchased File Recovery Insurance.
• Unedited or discarded images are not archived and cannot be retrieved.

5. Retouching & Post-Production

Professional retouching is included for any final image selections made during the signature headshot session or team headshot sessions. This includes advanced enhancements such as skin smoothing, color correction, and light cleanup. Express headshots do not include retouching and is sold as an add-on.
Advanced requests—such as background swaps, body modifications, or composites—will be quoted separately.
CLIENTS may not alter or apply filters to the images themselves. Any derivative edits must be requested and approved in writing.

6. Usage of Digital Files

Final images are licensed for use in personal, internal business, company websites, social media, and press releases — unless otherwise specified.
This standard usage license does not include rights for commercial advertising, paid media, sponsored content, product packaging, or third-party resale.
If you plan to use the images in marketing campaigns, advertisements, or commercial promotions, a separate licensing agreement is required.

Any third-party, promotional, resale, or advertising usage requires additional licensing. Please contact the CREATOR for a custom quote.

7. Travel Fees

The CREATOR’s assignments are typically conducted on location.

• For locations within 25 miles of Cedar Park, TX, no travel fees apply.
• For assignments located ~3 hours away (round trip), a $295 flat travel fee is applied.
• For assignments requiring 6+ hours round trip, a discounted half-day travel rate of $495 applies.
• For out-of-state or overnight travel, expenses such as airfare, hotel, and per diem may apply.

All travel-related costs will be clearly itemized in the final invoice.

8. Payment Terms

A non-refundable retainer fee is required to reserve all sessions. This retainer is applied toward the total balance due.
Remaining payments are due according to the schedule outlined in your booking agreement. Final files will not be delivered until the balance is paid in full.

For any payments over $1,500 made by credit card, a 3% processing fee will apply.

9. Cancellation & Rescheduling

We understand that life happens, and sometimes plans change. While we do our best to accommodate reschedules and last-minute changes, we also have policies in place to protect the time and resources we’ve set aside just for you.

When you book a session, we reserve that time exclusively for your team. That means we often turn away other clients in order to honor that commitment. Cancellations made too close to the scheduled date can’t always be filled — and that leads to lost time, preparation, and revenue.

To keep things fair, we require a retainer to hold your date. If you need to cancel or reschedule, we ask that you give us as much notice as possible. Sessions canceled or rescheduled on short notice may require a new retainer or partial payment to rebook.

Thanks for understanding — this policy ensures we can continue delivering the high level of service and preparation our clients rely on.

10. Client Conduct & Non-Disparagement

The CLIENT agrees to conduct themselves professionally during all interactions and allow reasonable opportunity to resolve concerns privately before posting public commentary.

While honest reviews are welcomed, the CLIENT agrees not to share false, misleading, or defamatory content about the CREATOR or their work. This includes verbal, written, or online communications.

11. Copyright & Ownership

All photographs remain the intellectual property of Anthony Johnson Photography and are protected under U.S. copyright law.
Clients receive a non-transferable, limited-use license to the final delivered images as outlined in their specific agreement. The CLIENT may not sell, sublicense, alter, or claim authorship of any delivered work.

12. Limitation of Liability

The CREATOR will take every reasonable measure to ensure a successful session and secure delivery. In the unlikely event of equipment failure, loss of files, illness, or other unforeseen circumstances beyond the CREATOR’s control, liability is limited to a rescheduled session or full refund—at the CREATOR’s discretion.

13. Legal Jurisdiction

This Agreement is governed by the laws of the State of Texas, and any disputes shall be resolved in the appropriate courts located in Williamson County, TX.
